Terms of service

These Terms of Service (the "Terms") govern your access to and use of the EvoTech website, online store, products, services, and EvoTech VIP Club. The website and store are operated by OJJ GROWTH PARTNERS LLC ("EvoTech," "we," "us," or "our").

By accessing the website, placing an order, or enrolling in the EvoTech VIP Club, you agree to these Terms. If you do not agree, do not use the website, place an order, or enroll in the EvoTech VIP Club.

1. Eligibility and United States Sales

You must be at least 18 years old and legally capable of entering into a binding contract to make a purchase or enroll in the EvoTech VIP Club.

We ship to customers in the United States and to many countries worldwide. Available destinations are those shown at checkout. We reserve the right to refuse, limit, or cancel an order for any destination we do not serve, or where shipping, sale, or import of a product is restricted by law.

Customs, Duties, and Import Charges. Orders shipped outside the United States may be subject to customs duties, import taxes, VAT, GST, brokerage fees, or other charges levied by the destination country. These charges are not included in the prices or shipping costs shown at checkout and are the responsibility of the recipient. Customs authorities may also open, inspect, or delay shipments, and delivery estimates do not include customs clearance time. If a shipment is refused at customs or abandoned by the recipient, any refund will be handled under Section 6.

Local Consumer Rights. If you are a consumer in the European Union, United Kingdom, or another jurisdiction that grants mandatory consumer protections, those protections apply to you regardless of Section 19 (Governing Law and Venue), and nothing in these Terms waives them.

2. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on the website with a revised effective date. Changes will apply prospectively unless applicable law permits otherwise. Material changes affecting an active VIP Club membership will be communicated as required by law.

3. Products and Availability

We make reasonable efforts to describe and display our products accurately. Colors, packaging, measurements, and other product details may vary slightly from what appears on your screen.

All products, promotions, discounts, and benefits are subject to availability. We may limit quantities, discontinue products, correct errors, or update product information at any time. If we discover a material pricing or product information error after you place an order, we may contact you for instructions or cancel the affected order and issue a refund.

4. Orders and Contract Formation

Product listings are invitations to submit an order and are not binding offers. When you submit an order, you offer to purchase the selected products and authorize us to charge the payment method provided.

We may accept or reject an order in our discretion, including because of product availability, suspected fraud, payment issues, inaccurate information, or shipping restrictions. An order is accepted when we send an order confirmation, charge your payment method, or ship the product, whichever occurs first.

You are responsible for providing accurate billing, shipping, contact, and payment information. Please review your order carefully before submitting it.

5. Prices, Taxes, and Payment

Prices are displayed in United States dollars unless stated otherwise. Applicable sales tax, shipping charges, and other charges will be shown during checkout before you complete your purchase.

You authorize us and our payment processors to charge the payment method you provide for the total amount shown at checkout. You represent that you are authorized to use that payment method.

We may use third party payment processors. Their services may be governed by additional terms and privacy policies. We remain responsible for customer service regarding orders placed directly through our website.

6. Shipping and Delivery

We ship to the delivery address provided during checkout. Delivery dates are estimates and are not guaranteed unless we expressly state otherwise. We are not responsible for delays outside our reasonable control, including carrier delays, customs clearance, and delays during peak periods.

You are responsible for entering a complete and accurate shipping address. If you provide an incorrect address, contact us promptly at info@shopevotech.co or +1 (866) 359-4999. We may attempt to redirect the shipment, but redirection cannot be guaranteed and additional carrier charges may apply.

Customs, Duties, and Import Charges. For orders shipped outside the United States, any customs duties, import taxes, VAT, GST, brokerage fees, or similar charges assessed by the destination country are not included in the amounts shown at checkout and are the responsibility of the recipient. Delivery estimates do not include customs clearance time. Customs authorities may inspect, hold, or delay shipments, and we have no control over those decisions.

Refused, Abandoned, and Undeliverable Shipments. If a shipment is refused by the recipient, abandoned at customs, held because import charges were not paid, or returned to us because the address was incorrect, incomplete, or otherwise undeliverable, we may deduct our actual, reasonable outbound shipping, return shipping, and handling costs from any refund, to the extent permitted by law. Any customs duties or import charges already paid to a destination country are not refundable by us. Where a package is destroyed or disposed of by customs rather than returned to us, we may be unable to issue a refund for the affected items.

Risk of loss and title pass to you when the order is delivered to the address you provided, except where applicable law requires otherwise.

7. Order Changes and Cancellation

To request an order change or cancellation, contact us within 12 hours after placing the order. We cannot guarantee that an order can be changed or cancelled after submission.

Once an order has shipped, it cannot be cancelled. You may request a return after delivery in accordance with Section 8.

8. Returns and Refunds

Unless a different policy is clearly disclosed for a specific product, you may request a return within 30 days after delivery. Before returning an item, contact info@shopevotech.co to obtain return instructions and authorization.

Unless the product is defective, damaged upon delivery, incorrect, or applicable law provides otherwise, you are responsible for return shipping costs. We recommend using a trackable shipping method because we are not responsible for returns lost in transit.

Returned products must be in the condition required by the return instructions. We may reduce or deny a refund for products that have been used, damaged, altered, or returned incomplete, except where prohibited by law.

After we receive and inspect an approved return, we will issue any approved refund to the original payment method, generally within 5 to 7 business days. Your financial institution may require additional processing time.

Nothing in this Section limits rights that cannot be waived under applicable law.

9. EvoTech VIP Club

9.1 Membership Benefits

The EvoTech VIP Club is a paid membership that includes:

  • Priority shipping

  • Free standard shipping on all items regardless of purchase amount

  • Our no risk guarantee, subject to the return and refund terms disclosed on the website

  • Access to exclusive products

  • Member discounts

Benefits are subject to availability and any reasonable conditions clearly disclosed on the website. Priority shipping does not include express or upgraded delivery unless we expressly state otherwise.

9.2 Express Enrollment Consent

The EvoTech VIP Club is optional. It will not be added to your purchase unless you actively select and consent to the membership during checkout.

Before completing checkout, you must check a separate consent box that clearly discloses the membership price, immediate first charge, 30 day automatic renewal, cancellation methods, and payment statement descriptor. By checking the box and completing the purchase, you expressly agree to the recurring membership and authorize the charges described below.

9.3 Price and Automatic Renewal

The EvoTech VIP Club costs $29.99 per 30 day membership period. The first $29.99 membership fee is charged immediately when you complete the purchase that includes the membership.

After the initial period, your membership automatically renews every 30 days. You authorize EvoTech to charge $29.99 to the payment method used at enrollment at the beginning of each renewal period until you cancel.

Membership charges will appear as "EvoTech" on your payment statement.

If a payment cannot be processed, we may retry the payment, request an updated payment method, suspend benefits, or cancel the membership.

9.4 Cancellation

You may cancel the EvoTech VIP Club at any time by:

Your cancellation will prevent the next automatic renewal. You must submit the cancellation before the next scheduled charge to avoid that charge. We will process cancellation requests promptly and in accordance with applicable law.

9.5 Effect of Cancellation and Membership Refunds

After cancellation, your membership and benefits remain active until the end of the current paid 30 day period. You will not be charged for another period after the cancellation becomes effective.

Membership fees already charged for a current or completed membership period are nonrefundable, and no prorated refund will be issued for unused days, except where required by applicable law. This policy does not limit any right or remedy that cannot legally be waived.

9.6 Changes to the Membership

We may change the membership price or materially modify the benefits by providing advance notice as required by applicable law. A price increase will not be charged without any consent required by law. You may cancel before a change takes effect.

10. Promotional Codes and Offers

Promotional codes and offers may be subject to separate eligibility requirements, expiration dates, product exclusions, and other conditions disclosed with the promotion. Unless expressly stated otherwise, promotional codes cannot be combined, exchanged for cash, applied after an order is completed, or transferred.

We may reject or cancel the use of a promotion obtained or used through fraud, mistake, misuse, or violation of its disclosed conditions.

11. Intellectual Property

The website and its content, including text, graphics, logos, images, videos, product names, designs, and software, are owned by or licensed to EvoTech and are protected by applicable intellectual property laws.

We grant you a limited, revocable, nonexclusive, nontransferable right to access and use the website for personal, lawful, noncommercial purposes. You may not copy, reproduce, distribute, modify, publicly display, sell, reverse engineer, scrape, or exploit any part of the website except with our prior written permission or as allowed by law.

12. Acceptable Use

You may not use the website to violate any law, infringe another person's rights, transmit malicious code, interfere with the website's operation or security, collect information without authorization, submit false information, commit fraud, or attempt to gain unauthorized access to any account or system.

We may suspend or terminate access to the website for conduct that violates these Terms or threatens customers, EvoTech, or third parties.

13. Disclaimer of Warranties

To the fullest extent permitted by law, the website and services are provided on an "as is" and "as available" basis. EvoTech disclaims implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement, except to the extent such warranties cannot legally be disclaimed.

We do not warrant that the website will always be available, uninterrupted, secure, or error free. Product warranties, if any, will be stated in the applicable product description or warranty documentation.

Some states do not allow certain warranty disclaimers, so parts of this Section may not apply to you.

14. Limitation of Liability

To the fullest extent permitted by law, EvoTech and its owners, officers, employees, agents, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from or related to the website, products, services, or these Terms.

To the fullest extent permitted by law, EvoTech's total liability for any claim will not exceed the amount you paid to EvoTech for the product or service giving rise to the claim during the 12 months before the event giving rise to liability.

These limitations do not apply to liability that cannot be limited or excluded under applicable law. Some states do not allow certain limitations of liability, so parts of this Section may not apply to you.

15. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless EvoTech and its owners, officers, employees, agents, and affiliates from claims, losses, liabilities, damages, and reasonable costs arising from your unlawful use of the website, your violation of these Terms, or your infringement of another person's rights.

This Section does not require a consumer to indemnify EvoTech for EvoTech's own unlawful, negligent, or willful conduct.

16. Third Party Services and Links

The website may contain links to or integrations with third party websites and services. We do not control and are not responsible for their content, availability, security, or practices. Your use of third party services is governed by their own terms and policies.

17. Privacy

Our collection and use of personal information are described in our Privacy Policy. By using the website, you acknowledge that you have reviewed the Privacy Policy.

18. Electronic Communications

You consent to receive order confirmations, receipts, notices, membership communications, and other transactional communications electronically. You are responsible for keeping your email address current and ensuring that our messages are not blocked by spam filters.

Marketing communications are subject to any separate consent and opt out rights required by law.

19. Governing Law and Venue

These Terms and any dispute arising from or relating to these Terms, the website, a purchase, or the EvoTech VIP Club are governed by the laws of the State of Utah, without regard to conflict of law principles.

Any lawsuit arising from or relating to these Terms must be brought in a state or federal court with jurisdiction in Salt Lake County, Utah. You and EvoTech consent to the personal jurisdiction and venue of those courts.

Nothing in this Section deprives a consumer of protections that cannot be waived under applicable law.

20. Force Majeure

We are not responsible for delay or failure caused by events beyond our reasonable control, including natural disasters, severe weather, war, terrorism, civil unrest, labor disputes, transportation interruptions, carrier delays, government actions, utility failures, cyberattacks, epidemics, or supply shortages. This Section does not excuse obligations that cannot legally be excused.

21. Severability and Waiver

If any provision of these Terms is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.

Our failure to enforce a provision is not a waiver of that provision or our right to enforce it later.

22. Assignment

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, corporate reorganization, sale of assets, or transfer of the business, subject to applicable law.

23. Entire Agreement

These Terms, the Privacy Policy, the applicable product description, any checkout disclosures, and any policies expressly incorporated by reference constitute the entire agreement between you and EvoTech regarding the applicable purchase or service.

If a specific checkout disclosure conflicts with a general provision of these Terms, the specific checkout disclosure controls with respect to that transaction to the extent permitted by law.
